The fast-track court in Taliparamba held a 44-year-old mason guilty of sexually abusing his 8-year-old son multiple times. A Bench of Justice Rajesh R sentenced 90 years of rigorous imprisonment and a fine of Rs. 1.25 lakh.
As per Section 377 of the IPC (unnatural offences), the man was sentenced to 10 years of imprisonment. Along with it, Sections 3(a), 5(l), (m) and (n) of the POCSO Act, which deals with penetrative sexual assault and aggravated penetrative sexual assault, were considered and were awarded 20 years for each section. However, he will have to serve only 20 years in prison as the sentences will run parallel.
The father inserted his penis in the mouth of his son on the 26th of July 2018. The minor informed that his father had done it several times before. His wife and two sons moved out of his house after the incident and are currently living in her parent’s house.
