Kerala High Court Directed To Remove The Details Of Woman In Connection To An Immoral Trafficking Case, From Social Media Platforms

A woman approached the Kerala High Court to remove her name, images, and other personal details from online platforms as they portrayed her as a person leading an immoral life.

She was the victim of a case under the Immoral Traffic (Prevention) Act, 1956. She stated that she was exposed to the media after the registration of the case and was subjected to severe humiliation and cyber-attacks. She added that no action was taken although she complained to authorities.

The Bench held that privacy is a constitutional core of human dignity and it is the ultimate expression of the sanctity of an individual“There cannot be dignity to an individual without privacy. It is a constitutional value founded on fundamental rights. Privacy with its attended values assures dignity to the individual. Dignity is the core which unites fundamental rights.”

Justice K Babu held that her exposure to social media is against the right to privacy and will affect her profession. The Court directed the State Police Chief to do the needful to remove her pictures from the sites.
