Breaking: Plea Seeking Clarification On Setting Up Of Isolation Rooms For Corona Positive Clat Aspirants Due For Hearing Tomorrow

Taking cognizance of the urgent application filed before the Supreme Court against the guidelines issued the Consortium over conduction of CLAT examinations, Case No. MA 1790/2020 in W.P.(C) No. 1030/2020 [Rakesh Kumar Agarwalla v. National Law School Of India University, Bengaluru] is listed for hearing on 28th September 2020 at 10 a.m. The matter will be adjourned by a three-judge bench comprising Justice Ashok Bhushan, Justice R. Subhash Reddy and Justice M.R. Shah.

The plea was moved before the Supreme Court by one COVID-19 positive CLAT Aspirant, Mr. Deepansh Tripathi on 26th September 2020 after a letter addressed to the Consortium of NLUs by three law students namely, Amit Agarwal, Priya Chaudhary and Kumar Harsh requesting an alternate remedy to the guideline[1], and it was pressed upon that since the entrance exam (CLAT 2020) is scheduled on 28th September 2020, the matter be heard urgently.

Earlier, the counsels appearing for the aspirant had moved an urgent application for mentioning the said plea on 27th September 2020.

It is pertinent to mention here that the impleadment application[2] has sought clarification to the aforementioned judgment and the assurance given via a YouTube live session by NLSIU Bangalore’s Vice Chancellor Sudhir Krishnaswamy for exam centres to have isolation rooms for symptomatic students so that they could take the exam smoothly. The applicant has alleged an infringement of his fundamental right under article 14 of the constitution.

The petition has been filed by Advocate Garima Prashad through Advocate Sumit Chander and Advocate Vinay Kumar.
