“The State Government has completely failed the citizens of Delhi. We have lost a lot of lives due to the complete failure of State Machinery. Due to mismanagement of resources, the State Government has not only created a shortage of essential items but has also created a logistical nightmare,” the said plea argues.

There has been inadequate medical infrastructure, the capital city is even not able to utilize the allocated quantity of oxygen due to poor response from the State Government, the petition argues.

The State Government is refusing to act and manage the issues that are arising and it seems that the State Government is only interested in politicising the severe situation of the capital city and to shun of its responsibility, the petition states.

“The net results of all these difficulties and hardships have a direct bearing on the lives of people of Delhi and they cannot be allowed to die because of any political or bureaucratic lack of coordination. And now as a result of all these failures, it is only the Army that can step in and do something about it to save the lives of the people of Delhi,” the said petition states.

“There is a complete failure of State Machinery and the State Government has failed Delhiites and therefore it is imperative that the Armed Forces are called in to manage the Supply and the logistics, the petition prays before the Court.

This petition is by nature urgent and was mentioned today before the division bench of Justices Vipin Sanghi and Rekha Palli for urgent listing by Senior Advocates Abhinav Vasisht, Sacchin Puri and Jagdeep Singh Bakshi.

The Delhi High Court has directed for the listing of the matter and has also directed the Centre to respond to the request of the Armed Forces helping in setting up hospitals and with various logistics issues being faced by the State Government of Delhi.

The Petition has been filed by Advocates Praveen K. Sharma and Dhananjay Grover.
