The Allahabad High Court on Friday refused to quash the charge-sheet filed against the Assistant Resident Engineer, for alleged corruption during procurement of pink sandstones for construction of memorials and parks in Lucknow and NOIDA.
The alleged scam took place under BSP rule, during the tenure of then UP CM Mayawati. The Petitioner, through Advocates Pradeep Kumar Rai, Prakarsh Pandey and Praveen Kumar Shukla, had alleged that the learner court had no jurisdiction to take cognizance of the matter and the charge-sheet and subsequent orders dated 08.02.2021 and 10.02.2021 were passed in violation of the directions issued by the Division Bench in Writ Petition no. 792/ 2020 (M/B) and that the learned court had no jurisdiction to try the matter.
The bench comprising of Hon’ble Justice Dinesh Kumar Singh disposed off the petition with the following directions-
“The petitioners are given the liberty to raise the question of validity at the time of trial and the trial court shall deal with the said issue afresh, without being influenced by its earlier order dated 08.02.2021.”
