The Supreme Court has issued official clarifications to address the rumours and misinformation regarding the transfer of Justice Yashwant Varma from Delhi High court to Allahabad High Court alleged recovery of cash from the residence.
According to the press release, the Chief Justice of the Delhi High Court had initiated the in-house enquiry procedure even before the Supreme Court Collegium convened its meeting on March 20, 2025. The Chief Justice of the Delhi High Court is set to submit his report to the Chief Justice of India on March 21, 2025, following which further necessary action will be determined.
The Supreme Court emphasized that the proposal to transfer Justice Verma from the Delhi High Court to his parent High Court in Allahabad is separate from the in-house enquiry procedure. This transfer is considered necessary as Justice Verma’s continued presence in the Delhi High Court might affect the enquiry process. The Supreme Court Collegium, consisting of the Chief Justice of India and the four senior-most Judges of the Supreme Court, deliberated on this proposal in its meeting on March 20, 2025.
Following this, letters were sent to the consultee Judges of the Supreme Court, the Chief Justices of the concerned High Courts, and Justice Verma himself, seeking their responses. The Collegium will evaluate the responses received and will proceed to pass a resolution accordingly.
The press release also referenced the judicial precedents governing the in-house enquiry procedure, citing the cases of C. Ravichandran Iyer v. Justice A.M. Bhattacharjee (1995) 5 SCC 457 and Additional District and Sessions Judge ‘X’ v. Registrar General, High Court of Madhya Pradesh (2015) 4 SCC 91, which outline the procedural framework for such inquiries.
