SC Refuses to Transfer NEET-UG 2025 Plea

On 26th June, 2025, the Supreme Court of India declined to transfer to itself a writ petition filed in the Delhi High Court challenging the conduct of the NEET-UG 2025 examination. The petitioner, represented by Advocate Subhash Jha, alleged that a required signal—presumably a procedural cue crucial during the exam—was not provided to the candidates, thereby affecting their performance.

However, the Supreme Court bench comprising Justice KV Viswanathan and Justice NK Singh observed that the petition raised issues that were specific to the individual circumstances of the petitioner and did not involve any broader legal question or challenge to the constitutionality or validity of a law. On this basis, the bench held that the Delhi High Court was the appropriate forum to adjudicate such fact-based grievances.

The petitioner’s counsel had requested the transfer to prevent the possibility of conflicting decisions by different High Courts, but the Supreme Court clarified that a transfer is warranted only when similar legal questions are pending before multiple High Courts. Since the Delhi High Court had already scheduled the hearing for 31st July, the bench acknowledged the petitioner’s concern that by then, medical seats might already be filled. Therefore, the Supreme Court permitted the petitioner to approach the Chief Justice of the Delhi High Court to request an earlier hearing.

In a related development, the Madhya Pradesh High Court is also hearing a separate petition by candidates who allege that their NEET-UG 2025 performance was adversely affected due to a power outage at examination centres in Indore, indicating that multiple region-specific grievances regarding the conduct of the exam are emerging.
