On November 10, the Supreme Court rejected the plea by the Mosque Committee to stay the Allahabad High Court’s decision to transfer all suits related to the Krishna Janmabhoomi-Shahi Idgah dispute from the Mathura Court. Justices SK Kaul, Sudhanshu Dhulia, and Ahsanuddin Amanullah deemed it unfair to intervene in the high court’s order without hearing both sides.
The Registrar General of the Allahabad High Court previously apologized to the Supreme Court for the delay in submitting a report on the suits transferred to the High Court regarding the Krishna Janmabhoomi dispute. In an affidavit, the Registrar General expressed regret and assured greater vigilance in the future.
The High Court had directed the transfer of 16 civil suits related to the dispute from the Mathura Court. The Supreme Court had earlier suggested that the matter might be better resolved at the High Court level and that consolidation of all suits under a higher authority could be in the broader interest.
Additionally, the Supreme Court had recently refused to entertain a Special Leave Petition against the High Court’s order dismissing a plea for a scientific survey of the Krishna Janmabhoomi-Shahi Idgah premises.
The bench, led by Justice SK Kaul, emphasized that the Mathura Civil Court’s order was not without jurisdiction, as it was issued before the transfer of all suits to the High Court.
