SC Collegium Recommends Bombay HC CJ Devendra Kumar Upadhyaya transfer to Delhi HC

On 7th of January, the Supreme Court Collegium recommended that the current Bombay High Court Chief Justice, Devendra Kumar Upadhyaya be transferred to the Delhi High Court.

Justice Upadhyaya was born in 1965 and was appointed as an additional judge at the Allahabad High Court in 2011. He was elevated to being permanent judge at the Allahabad High Court in 2013. In 2023, Justice Upadhyaya took oath as the Chief Justice of the Bombay High Court.

The Collegium further recommended the transfer of Telangana High Court Chief Justice Alok Aradhe to the Bombay High Court. Justice Aradhe was appointed additional judge at the Madhya Pradesh High Court in 2009 and was elevated as permanent judge at the Madhya Pradesh High Court in 2011. He took oath as the Chief Justice of the Telangana High Court in 2023.

As per Article 223 of the Indian Constitution, the President has the authority to appoint a puisne judge as the acting Chief Justice of any High Court. When such position is vacant or when the Chief Justice, is unable to carry out their duties due to absence or any other reason.
