ABOUT THE FDP 

The Indian Constitution was envisaged by the Constituent Assembly as an instrument of social  engineering aiming to inculcate the values of equality, liberty, and fraternity in the political,  legal and social structure of the country. These values are found embedded in fundamental rights, functions of democratic institution, relationship between state and individuals. In the words of Granville Austin, “it is a social document”. 

Indian Constitution has survived the test of time by adapting to the growing social and political complexities. The doctrine of Basic Structure propounded by the Supreme Court allowed the  Constitution to absorb the majoritarian shocks while preserving the essence of the Constitution which is not amenable to legislative will.  

21st Century has seen a rapid change in the political, legal, social, and economic structure of the society. This growth has challenged the Constitutional understanding of fundamental rights, duties, role of legal institutions. Whether we take into consideration the changing norms of gender rights, interface of customary law and legal rights, duties of the state in elimination of poverty and securing financial justice and the growing challenges of the digital era etc, the constitution has played an important role. These changes are continuously pushing towards evolving Constitutional jurisprudence and democratic institutions, especially in the context of various transformative judgments pronounced by Indian Judiciary. 

This FDP aims to explore and tap this very relevant area of Constitutional importance. To understand and explore the foundations, evolution, dimensions, and challenges to Indian  Constitution in -transforming the society. It is designed to bring academicians and researchers from various disciplines around the globe to a common platform for exchanging and sharing the latest development and upcoming challenges to Constitutionalism. The participants will not only gain extensive knowledge and perspectives in this field but will also be successful in grappling with the various nuances of this concept.  

GOAL AND OBJECTIVES 

  1. To examine the conceptual and philosophical foundation of Constitution and its role in shaping the society. 
  2. To explore different problem areas and emerging challenges to Constitutional ideology and factors responsible for establishing a peaceful and vibrant democracy.
  3. To abreast the participants with the recent developments and emerging challenges to  Constitution. 
  4. To sensitize participants about the inherent conflicts involved with implementation of constitutional rights in achieving socio-political objectives.

  1. Evolving contours of Constitution, Constitutionalism and Constitutional Morality. 2. Majoritarianism and Judicial intervention.  
  2. Human Rights and Social Justice 
  3. Emerging trends in Gender rights. 
  4. Minority rights and challenges to secularism. 
  5. Interpreting the Constitution in the digital era.  
  6. Education and learning as a fundamental right. 
  7. Interplay of Constitution and international issues.  
  8. State accountability and Environmental jurisprudence. 
  9. Relevance and context of Fundamental Duties
  10. Corporate Governance and Economic Justice  
  11. Education as a tool for creating a just society. 

EXPECTED RESULTS OR OUTPUTS  

  1. To acquaint the participants with the knowledge of Constitution, its role and functions. 
  2. To instil conceptual understanding of the concept of constitutionalism and its place in  different political and social setup.  
  3. Enumerate the intersection of Constitution rights within different spheres of democratic systems like gender rights, minority rights etc.  
  4. Improve and add to the existing knowledge on Constitutional issues. 5. To generate fresh perspectives on the subject matter from the discussions.  

ACTIVITIES AND DURATION  

1 Week (6 days)- 30 June 2022- 6th July 2022 (except Sunday) 

There will be three sessions each day, of one-and-a-half-hour duration. 

One activity session of 30 minutes will be organized on each day of the FDP. For each activity,  the participant with the most contribution, attentiveness etc. will be acknowledged.
