About the faculty:
Mr. Prakarsh Pandey is an advocate practicing at Allahabad High Court, Lucknow bench. In five years, he has appeared in a variety of cases which includes criminal matters, Service matters, customer matters, public interest litigation and so on. Course Introduction
The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act of 2013, is fundamental in preventing sexual harassment against women. The POSH Policy now forms an inseparable part of the institutions, be it private or public; organized or unorganized. This comprehensive POSH Training Course thus helps one to have a holistic understanding of the legal framework of the POSH policies and the importance of compliances to its provisions.
The simplified explanation of the Sections of the Act with the help of the case laws gives a deeper and unambiguous understanding of the interpretation of the intention of the legislation. Such understanding of the provisions is necessary for everyone including the employee, employer and the ICC members. This helps to avoid a miscarriage of justice and most importantly, it helps to achieve the aim of providing a safe and healthy workplace for women.

History of the PoSH Act
The history behind the enactment of the Act could be understood with the help of the Landmark Judgements that have been summarised and explained comprehensively. Case laws also highlight the criminal legal proceeding which one follows if they wish to. An aggrieved party can approach the Court in case of the absence of a complaints committee or lack of faith in the inquiry procedure. The decisions of the Committee may also be challenged in the Court of law on valid grounds.
The course also enlightens about the status of the POSH Act in the light of the #MeToo Movement. With this, we realise that many aggrieved women do not come forward to speak up and file a complaint against sexual harassment due to several reasons, like lack of evidence or social stigma attached to such incidents. This also makes us realise the importance of the POSH Act, as it saves women from going through the tedious legal proceedings that may otherwise take place in the Court of law. The POSH Act makes the procedure speedy and efficient as the Act prescribes a time-bound inquiry and disposal of the complaint.

About the Course Faculty
Ms Smeeksha Pandey completed her under graduation BA.LLB. (H) Specialization in IPR from Amity Law School, Noida. She went on to practice in Indore High Court. She did her Masters from Hidayatullaha National Law University, Raipur, in Intellectual Property Rights. She has also pursued many certified courses in POSH from IALM Delhi and Justice and Children’s Rights from HarvardEdx. She possesses three years of experience in the field of litigation and has done many sessions on various socio-legal issues in the past year.
Presently, she is pursuing Masters in International and Commercial Arbitration at the University of Westminster, London. Previously she has taught law students and CLAT aspirants while actively doing counselling and mediation in association with online Alternate Dispute Resolution platforms. Besides, she headed the Jabalpur District Lok Adalat as the district core organised by SAMA Online Alternate Dispute Resolution Platform. She is also a Council Member at the Women’s Indian Chamber of Commerce and Industry (WICCI).
