On 11th November, the Delhi High Court issued an interim order barring Gurgaon-based restaurant Wow! Delicious from using a trademark that closely resembles the well-known and popular fast-food brand Wow! Momo. The case, titled Wow Momo Foods Pvt Ltd vs. Wow Delicious, was heard by Justice Mini Pushkarna, who observed that the plaintiff had established a prima facie case of trademark infringement. The judge noted that the use of a deceptively similar mark could potentially mislead consumers and harm the goodwill of the established brand.
Wow! Momo, founded in 2008 in Kolkata, has grown into one of India’s leading fast-food chains, specializing in momos—steamed or fried dumplings filled with a variety of ingredients such as vegetables, chicken, or mutton. With over 600 outlets across the country, the brand enjoys widespread recognition in the Indian food industry. On the other hand, Wow! Delicious, located in Subhash Chowk, Gurgaon, offers a range of dishes, including Chinese cuisine and snacks, and operates on popular delivery platforms like Zomato.
Advocate Ankur Sangal, representing Wow! Momo, argued that the defendant’s use of the term “Wow” in its branding violated trademark rights under the Trademarks Act, 1999. He highlighted that Wow! Momo had registered its trademark under classes 30 and 43 more than a decade ago. These categories cover a wide array of food and beverage services, including restaurants and catering.
The Court granted ex-parte ad interim relief to Wow! Momo and scheduled the next hearing for April 2025.
This case follows a pattern of trademark disputes involving Wow! Momo. In March 2024, the Court restrained Wow! Punjabi from using a similar name, and in August 2023, the fast-food chain was itself restrained from using Wow! China Bistro after a suit filed by China Bistro.
