The Delhi High Court, on 10th December 2024, issued a summons to the SpiceJet Executives, Chief Operating Officer (COO) and Chief Executive Officer (CEO) and directed them to remain present in Court on the next hearing date, on 16.01.2025. The order was issued under Order XXXIX Rule 1 and 2 of the Civil Procedure Code, 1908, dealing with interim relief for injunctions and compliance.
The application was filed on behalf of the decree-holder to comply with the direction as per earlier consent orders in two cases under which SpiceJet has to pay $6,03,870.82 to Team France 01 S.A.S. The issue was raised when the payment hadn’t been made yet, leading to this execution proceeding.
The Court denied relief for adjournment as the Judgment debtor’s counsel sought an adjournment due to the Senior Counsel’s unavailability, and it specifically refused any request for the appearance of the officers via video conferencing.
