Delhi High Court Grants Injunction to Saregama India in Copyright Infringement Case

The Delhi High Court, on December 19, 2024, passed an ex-parte ad-interim injunction to Saregama India (Petitioner) and restrained the Movie World Visual Media (defendants) from exploiting the plaintiff’s copyrighted works. 

While hearing a commercial dispute, Saregama India Limited v. Movie World Visual Media Private Limited & Anr., involving the infringement of copyright in sound recordings, literary and musical works related to 88 cinematograph films, Justice Mini Pushkarna passed the order. 

The Court observed that the plaintiff owns copyright through assignment agreements executed between 1965 and 1988, granting them perpetual and worldwide rights. Allegedly, the defendants exploited the rights over the works through various channels, including websites, mobile applications, and OTT platforms. 

Further, the petitioner argued that by illegally using Saregama’s copyrighted works, Movie World Visual Media (defendants) made the false impression that the rights either belonged to the original producers or were owned by the defendants.

The plaintiff referred to a related case in the Ernakulam District Court, Movie World Visual Media v. Saregama India Ltd. OS/0100030/2024, where their rights were upheld. 

Further, the Case was listed before the Joint Registrar for marking exhibits on February 10, 2025, and before the Court on May 13, 2025.
