On 1 August 2025, the Delhi High Court received updates related to the ongoing legal dispute between Dabur India Ltd. & Patanjali Ayurved Ltd. (CS(COMM) 33/2025 with I.A. 913-915/2025) about the trade dress of Patanjali’s Dant Kanti Red toothpaste. The court was informed that mediation efforts aimed to resolve the conflict that had failed in the ongoing dispute. Justice Manmeet Pritam Singh Arora presiding over the Case.
Dabur has accused Patanjali of packaging its Dant Kanti Red toothpaste, which closely resembles the trade dress of Dabur’s own product, Dabur Red toothpaste. So, it misleads consumers about the origins & quality of the products, potentially infringing on Dabur’s established market presence. Dabur emphasised that Patanjali’s new packaging was introduced only in December 2024.
On 15 July 2023, the matter was directed to mediation, during which the court encouraged Patanjali to modify its trade dress to avoid confusion among consumers. Despite these efforts, both parties subsequently informed the court that the mediation process was unsuccessful.
Dabur initiated a lawsuit against an advertisement of Patanjali, Swami Ramdev questioned the authenticity & quality of other Chyawanprash products which are available in the market. Dabur contended that this advertisement was misleading to consumers & weakened trust in a category governed by stringent regulatory standards.
The Delhi High Court issued an interim order in July 2025, mandating that Patanjali cease broadcasting any insulting advertisements targeting Dabur’s Chyawanprash products, providing a temporary reprieve for Dabur among ongoing legal challenges.
