CJI Gavai Highlights Commitment to Collective Decision-Making in the Supreme Court

On 28th June 2025, the Chief Justice of India, BR Gavai, along with his predecessors Justices U.U. Lalit and Sanjiv Khanna, other judges, addressed the perception that the Supreme Court operates solely under the authority of the Chief Justice.

Speaking at a felicitation function hosted by the Nagpur High Court Bar Association, CJI Gavai emphasised that all three of them had actively encouraged participative decision-making among the bench. He recalled that both he and Justice Lalit convened full court meetings immediately upon assuming office as CJI.

CJI Gavai further shared his views on the judiciary’s constitutional role, emphasising the need for each branch of government to remain within its defined boundaries. He affirmed the value of judicial intervention in times of executive or legislative failure, but also cautioned against its overreach.

Among his proudest achievements as Chief Justice, Gavai highlighted the reforms regarding judicial pensions. He introduced the “one rank, one pension” principle to address disparities among retired judges. He expressed concern over cases where retired High Court judges were struggling to live on meagre pensions of only ₹7,000 to ₹8,000.

Regarding judicial appointments, the Chief Justice emphasised that the collegium system is dedicated to maintaining transparency, merit, and seniority. He pointed out Justice Atul Chandurkar as an example of how to balance merit and fairness in the selection process.
