On 15 July 2025, the Delhi High Court has issued summons in a trademark infringement and passing off lawsuit which is initiated by the well-known footwear brand Campus against the online apparel company Campus Sutra. This legal dispute centers around the stand-alone usage of the trademark ‘Campus’ by Campus Sutra, which Campus claims infringes upon its established brand identity.
Justice Amit Bansal presided over the preliminary hearing and has instructed Campus Sutra to submit a substantive reply to the court within a period of four weeks. The matter has been scheduled for further proceedings on November 10. In a notable development, Campus Sutra has committed to refraining from using the mark ‘CAMPUS’ on a standalone basis regarding any of its products during the pendency of this case.
During the proceedings, Senior counsel representing Campus Sutra argued that the company has been using the composite mark ‘CAMPUS SUTRA’ for its apparel since 2012. They highlighted that the ‘CAMPUS’ mark has not been utilized in connection with footwear. Furthermore, it was disclosed that, unintentionally, three out of 11,000 designs bearing the standalone ‘CAMPUS’ mark were listed online. The defendant has proactively reached out to various e-commerce platforms, requesting the removal of these listings to mitigate any potential confusion among consumers.
In its complaint, Campus is seeking to restrain Campus Sutra from selling any products that feature the marks ‘CAMPUS’ or ‘CAMPUS SUTRA’, or any other trademarks that may be deceptively similar to Campus’s registered mark. The court has ordered that the written statement from Campus Sutra be filed within thirty days. Additionally, the court has granted Campus the liberty to file a replication, if necessary, within thirty days of receiving the defendant’s written statement.
Moreover, the court noted that both parties are open to exploring the possibility of reaching an out-of-court settlement, indicating an interest in resolving the matter amicably outside of the courtroom.
