The Bengaluru City Civil Court on the 4th of January granted bail to the three accused in the Atul Subhash suicide case. The wife of the deceased, Nikita Singhania, deceased’s mother-in-law, and brother-in-law were arrested on 15th of December 2024 in connection with the death of Atul Subhash.
Nikita Singhania was arrested in Gurugram, and the other two accused were arrested in Prayagraj. They were then brought before the Bengaluru City Civil Court and sent to 14-day judicial custody. The Advocate representing the deceased informed that the viral video of Subhash and his hand-written note has been sent to forensics for examination. He further stated that the bail was allowed and assured that the bail order will be challenged before the High Court of Karnataka. Advocates for the accused argued that the arrest had been made on basis of the alleged suicide note and a viral video over the internet.
A petition was moved by the accused in the High Court of Karnataka. Petitioners argued that no ingredients were made out in the complaint by the deceased’s family for abetment under S. 108 r/w S. 3(5) of BNS. They further contended that the complaint did not state any actions made by them which showed cause of abetment, and that they cannot be booked for abetment merely on the grounds of a case being lodged.
The Court remarked that the complaint was fairly detailed and all necessary ingredients were made out in the complaint.
