Denial of Bail for Sharing ‘Pakistan Zindabad’ Facebook Post: Allahabad High Court

On 26th June 2025, the Allahabad High Court denied bail to 62-year-old Ansar Ahmad Siddique, who is accused of circulating a Facebook post containing the phrase “Pakistan Zindabad.” Justice Siddharth heard the matter, and he remarked that Siddique’s online activity demonstrated a disregard for constitutional values and was indicative of challenging the sovereignty of the nation.

He expressed concern that incidents of this nature have become more frequent. He attributes this trend to the result of excessive leniency by the judiciary toward individuals with views contrary to the national interest. The court labelled the content of the post as both “anti-social” and “anti-India” and noted its potentially harmful impact on national unity and territorial integrity.

The judgment also emphasised the duties outlined in Article 51-A of the Constitution, specifically the obligation of all citizens to uphold the Constitution, show respect for national symbols, and safeguard the country’s sovereignty and unity.

After weighing the submissions of both parties, the Court ruled against granting bail and instructed the trial court to expedite proceedings. The judge concluded that increasing instances of such offences are partly due to judicial leniency toward individuals holding anti-national views, making this an inappropriate case for bail at the current stage.
