The Allahabad High Court recently intervened in a case affecting three minor children expelled from a private school in Amroha, UP. They were allegedly expelled for bringing non-vegetarian food in their tiffins.
On December 17, 2024, the Court passed an order granting the interim relief, directing the District Magistrate (DM) of Amroha to ensure the admission of these expelled children into another CBSE-affiliated school within two weeks tenure and to submit a compliance affidavit for the same.
Failure in compliance would require the DM to appear personally before the Court on January 6, 2025.
A Bench comprising Justices Siddharth and Subhash Chandra Sharma heard the case. The petitioners alleged that the actions of the school violated their fundamental right to education under Article 21A of the Constitution of India.
The expelled students were in kindergarten, first grade, and third grade. The petitioner strived for directions for the immediate admission of students to an alternative school and punitive action against the principal for harassment and discrimination.
The next hearing on the matter is scheduled for January 6, 2025.
