All India Students Association Seeks Suo Moto Cognizance Of The Hon’ble Supreme Court Against CBSE’s Direction To Conduct Compartment Examination

A letter petition was moved to the Supreme Court by All India Students Association with 808 student signatories seeking suo moto cognizance of the Hon’ble Supreme Court against CBSE’s direction to conduct compartment examination.   

CBSE declared the results for class X and XII on 13.07.2020, and 15.07.2020 in which around 150198 students of class X and 87651 of class XII received compartment. 

CBSE issued a direction regarding compartment examination on 06.08.2020, where it provided for the conduct of compartment examination for students of class X and XII. It failed to take into account the present health crisis that the country is witnessing. 

Students are surrounded by a cloud of uncertainty as no information regarding the examination schedule or mode of the exam has been provided by CBSE.

The said letter petition is filed, inter-alia, on the following grounds-

  1. With the ongoing situation of a health crisis due to Covid-19, CBSE’s said direction violates the right to health as enshrined in right to life in the Indian Constitution as it fails to consider the principles of health, safety and fair & equal opportunity for the students.
  2. The problem with the offline examination is that many schools have been turned into quarantine centers. With the steep increase in the cases of infected people by the deadly virus, the chances of being exposed to it is extremely high for the students, teachers and staff members of the school and as well as parents if the exams are conducted offline.
  3. During this time, when the world is relying on the online mode of working, carrying of examination in this process isn’t the solution. Many students don’t have internet connections or personal computers laptops in their homes, which are imperative for this kind of mode.
  4. The future of scores of students is at stake as many colleges have already announced closure dates for admission.
  5. Also, online classes for the ones who have been promoted have already started. Thus these students have been left in uncertainty regarding the examination
  6. CBSE’s decision is also against MHA guidelines dated 29.07.2020 as it calls for closure for all educational institutions, schools and colleges till 31st August.

Therefore, the students seek appropriate directions from the Hon’ble Supreme Court to avoid unfair, unjust and unequal treatment of the students.
