Karnataka High Court Urges Couple to Seek Spiritual Guidance for Marital Reconciliation

On September 22, the Karnataka High Court encouraged a married couple seeking divorce to explore reconciliation through spiritual guidance. The Division Bench, comprising Justice Krishna S Dixit and Justice Vijay Kumar Patil, observed that both parties were well-educated and came from respected cultural backgrounds. Their interaction with the Court revealed that they both acknowledged the inevitable ups and downs in any marriage.

In a unique suggestion, the Court proposed that the couple seek advice and blessings from a spiritual leader, which the couple willingly accepted. “They happily agreed with the suggestion of this Court that they should seek some blessings & guidance from a tall person,” the Bench noted. Both parties chose His Holiness Shri Abhinava Gavisiddeshwara Swamiji of Shri Gavisiddeshwara Mutt in Koppal for spiritual counsel.

The case involved the husband challenging a trial court order that had dismissed his petition for divorce and granted his wife’s plea for restitution of conjugal rights under the Hindu Marriage Act. However, the agreement to meet the spiritual leader was seen as a positive step toward resolving their differences.

The Court further stated, “In the above circumstances, we pray His Holiness Shri Abhinava Gavisiddeshwara Swamiji to bless both parties on 22.09.2024, after ascertaining his availability & convenience.” A copy of the order was directed to be sent to His Holiness, as the couple sought his wisdom in addressing their marital issues.

By involving a spiritual leader in this legal matter, the Court emphasized an alternative approach to conflict resolution, focusing on harmony and mutual understanding.
